Sexual Harassment Defense Attorneys in Utah
What are My Defenses as an Employer?
As an employer, you are responsible for your employees. You take the heat when things don’t go well with your customers, and your employees look to you to sort our disagreements among themselves. But, that doesn’t mean that you are responsible for every action that every employee does, on the clock or not.
If the alleged harassment involves your employees takes place outside of work, then you and your company have no duty to prevent it. Where sexual harassment cases get, sticky is when an employee engages in harassing behavior on company property or during employment activities. In these cases, you are only liable for the harassment if you were put on notice of the allegation and have had a chance to investigate and solve the problem internally.
