It is generally unadvised to speak with the police if they are investigating a crime, as any statement you make may be used against you in court. Additionally, if the police believe that what you said is false or misleading, it could lead to charges of obstructing justice or perjuring yourself. It is best to remain silent and ask for an attorney before speaking further with police.

Q: What is the difference between a misdemeanor and a felony under Utah law?

Under Utah law, a misdemeanor is considered a less serious offense than a felony, and generally involves fines and/or jail time of up to one year. Felonies are more serious offenses that involve larger fines and potential prison sentences of one year or more. The classification of an offense as either a misdemeanor or felony usually depends on the severity of the crime, any prior convictions, the age of the defendant, and/or if weapons were used during the alleged violation.

Q: What is a "plea in abeyance"?

A plea in abeyance is a type of plea agreement in which a criminal defendant enters a guilty or no contest plea, but the conviction is temporarily delayed. The court may choose to not enter the plea and delay sentencing until the defendant satisfies certain requirements (such as probation or community service). If those requirements are met, the charges can be dismissed and no conviction will be entered.

Q: Who is liable for damage caused to shared roof in an HOA?

In the case of roof damage shared by multiple owners who are all members of the same Homeowners Association (HOA), whomever caused the damage is liable for repairs. If it cannot be determined which owner specifically caused the damage, then the HOA or its insurance policy may cover the repair costs. If no HOA exists and/or there is no insurance policy in place, liability will likely fall on those responsible for maintaining and repairing the common areas, such as a property management company or homeowners board.
